Certification Terms and Conditions

We Want You to Know What the Back of the Certification Says

LeakFREE® Certified Roof®: A roof that had a Visual Roof™ inspection by an authorized Inspector, who determined that the roof is currently LeakFREE® and satisfies the Sustainable Roof™ criteria and which a LeakFREE® Roof Certification is issued. (See below for more information on the Limited Service Agreement, priority service, discounted rates for future services, transferability and scope of services.)

VISUAL ROOF™: A visual, nondestructive inspection that is limited to checking whether the roof currently has leaks or, based on its current condition, has a likelihood to leak during a LeakFREE® Roof Certification period. The inspection encompasses visually inspecting interior ceilings, exterior roof eaves for signs of leakage and a rooftop current and potential leak evaluation only. If a different or a more comprehensive inspection is desired, then the Forensic ROOF® inspection should be purchased.

FORENSIC ROOF®: A separate comprehensive roof inspection that can address, at Client’s option, may include but is not limited to, the following for an additional charge(s): asbestos testing of roof materials, mold presence, building code compliance, manufacturer’s installation specification compliance, workmanship evaluation, inspection of walking decks, water testing, determination of roof slope, ponding, drainage and structural engineering analysis of the weight of the roof material to the structural design. Inspection(s) shall be performed by outside independent experts in the relative field and can be coordinated by Inspector. Approximate cost: $1,800 plus specialized inspection charges.

SUSTAINABLE ROOF™: A roof that it is in sufficient condition to be repaired by an authorized repairman to last the duration of the LeakFREE® Roof Certification period should a leak occur. A “ Sustainable Roof”™ does not imply the roof or portion of roof would withstand damage caused by acts of God or by third parties, which acts could necessitate replacement of the roof. A repair to a “ Sustainable Roof”™ is expected to last through the LeakFREE® Roof Certification period only, and may still need to be repaired or replaced at some time after the LeakFREE® Roof Certification period expires.

1)The Inspector designated on the face of this agreement (hereinafter “Inspector”) is an authorized dealer for the LeakFREE® Roof Certification and is an independently owned and operated business and is the sole responsible party for the Services herein.

2)Purchaser of this Certificate (hereinafter “Client”) has read and understands that the optional inspection services are available and wishes to hire Inspector only to perform a Visual ROOF™ inspection to obtain a LeakFREE® Roof Certification certificate with a limited service agreement (hereinafter “LeakFREE® Roof Certification”). LeakFREE® Roof Certification applies only to residential, single family houses.

3)The Inspector and Client acknowledge that this Agreement is a service contract and not an insurance policy or guarantee. It is futher acknowledged that The LeakFREE® Roof Certification is incidental to the purchase or value of the real property described in this Agreement.

4)The representations of the LeakFREE® Roof Certification are made to the Client only, and for no other purpose than in connection with the services provided hereunder and pursuant to the LeakFREE® Roof Certification. The LeakFREE® Roof Certification period is valid for the period of time as set forth on the face of document from date of issuance. The LeakFREE® Roof Certification can only be transferred according to the terms and conditions herein.

5)Client agrees to allow Inspector to perform an annual complementary Visual ROOF™ inspection of the roof as an express condition of the LeakFREE® Roof Certification being valid.

6)Client must maintain an all-risk homeowner property damage and liability insurance policy.

7)Client will notify Inspector of all leaks within twenty-four (24) hours of discovery of any leaks.

8)All subsequent inspections of the roof shall be performed by Inspector or Inspector’s representatives only; otherwise LeakFREE® Roof Certification is void. Because of the potential for third parties to cause damages to the roof, Client agrees to hold harmless and indemnify inspector from any claims arising out of Client and/or third parties, entering on to the roof on Client’s behalf.

Transferring the LeakFREE® Roof Certification

1)If the subject property is sold, this LeakFREE® Roof Certification is transferable to the first successor owner only, subject to all the terms and conditions herein and only when transferee (hereinafter also referred to as “Client”) has signed the face of the agreement accepting its entire terms and conditions and has paid the $25.00 transfer fee. Transfer of rights is valid only if, within 10 days of recordation of transfer of title, Client/transferee notifies Inspector of transfer by sending a complete copy LeakFREE® Roof Certification document signed by transferee by returnreceipt mail along with transfer payment.
